The attention of the Lagos State Law Enforcement Agency has been drawn to the recent increase in the number of sex in the car acts and other immoral conducts, involving lovers getting freaky in vehicles parked at public space.
As such, the Lagos State Law Enforcement Agency seek to remind and re-orientate the public on the law that addresses the case of immoral conduct at public space.
The Lagos state Criminal Law 2015 Section 134 (a) prohibits any indecent act in any public place without lawful excuse. The law holds that such person is liable on conviction to 2 years imprisonment.
The statement further cited The Lagos State Criminal Law 2015 Section 136, which provides that any person who commits any act of gross indecency with another person in public commits an offense and liable on conviction to 3 years imprisonment.
It must be noted that section 134 which deals with offenses against morality particularly, section 134 (a) have it that indecent act in a public place makes both parties engaging in the act liable to imprisonment for 2 years.
As far back as 2018, there was a similar case of sex in the car parked at public space, where a lot of social media users shared their opinions. Edgal Imohimi, the former Lagos state commissioner of police, as at 2018 said the state criminal law prohibits engaging in sexual activities in a public space.
The former commissioner said that, in reaction to social media comments which trailed the position of Abayomi Shogunle, the head of “PCRRU” public complaint rapid response unit of the police, that as long as sex in the car is consensual and not done in a place of worship, it is not a crime. But the former commissioner of police further added that, it is an act of indecency for couple to engage in sexual activities in their cars parked at public space or any other public place.
In conclusion, the authorities of the Lagos State Law Enforcement Agency hereby re-declares that the assertion of sex in the car parked at public space is not a crime in Lagos State is misplaced as the provisions of the Lagos State Criminal Law prohibits such acts in public space even if the act is done with the consent of both parties involved.
